1. Acceptance of Terms

By creating an account, accessing, or using Badger AI, you agree to:

If you do not agree to these Terms, you may not use the service.

2. Service Description

Badger AI is an AI-powered police report writing assistant that:

• Helps law enforcement officers create professional incident reports
• Uses artificial intelligence to generate report narratives
• Provides quality control and scoring for reports
• Stores and manages report history
• Offers multiple subscription tiers with varying usage limits

The service is provided "as is" and we reserve the right to modify or discontinue features at any time.

3. Eligibility and Account Registration

3.1 Eligibility

To use Badger AI, you must:

• Be at least 18 years of age
• Be affiliated with a law enforcement agency or authorized organization
• Have the authority to use the service on behalf of your agency
• Comply with all applicable laws and regulations

3.2 Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Ensuring your account information is accurate and current
• Complying with your subscription tier's usage limits

4. Acceptable Use Policy

4.1 Permitted Uses

You may use Badger AI for:

• Creating law enforcement incident reports
• Training and familiarization purposes
• Testing and evaluation of the service
• Official law enforcement purposes in accordance with your agency's policies

4.2 Prohibited Uses

You may NOT use Badger AI to:

• Violate any laws, regulations, or third-party rights
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to our systems
• Reverse engineer or copy our software or AI models
• Use the service for any commercial purpose outside of official duties
• Share your account with unauthorized persons
• Create false or misleading reports
• Abuse or circumvent subscription limits or the referral program

4.3 Agency Policy Compliance

You must use Badger AI in accordance with your agency's policies, procedures, and guidelines. This includes but is not limited to:

• Obtaining any required approvals before using AI-assisted report writing tools
• Following your agency's protocols for report creation and submission
• Adhering to your agency's standards for documentation and record-keeping
• Complying with your agency's technology use policies

If your agency's policies conflict with these Terms or prohibit the use of AI tools, you must not use Badger AI until such conflicts are resolved or proper authorization is obtained.

4.4 Transparency and Disclosure Requirements

IMPORTANT: For true defensibility of reports generated using Badger AI, users must be transparent about the use of AI assistance. You agree to:

• Disclose the use of AI assistance in report generation when required by your agency's policies
• Be prepared to explain your use of Badger AI if questioned during legal proceedings
• Maintain records of AI-assisted report creation as required by your agency
• Not misrepresent AI-generated content as solely human-created when transparency is required

Transparency regarding AI usage helps maintain the integrity and defensibility of your reports. Consult with your agency's legal counsel or supervisors regarding disclosure requirements for AI-assisted report writing.

5. AI-Generated Content and Accuracy

5.1 AI Limitations

You acknowledge that:

• Badger AI uses artificial intelligence which may produce errors
• AI-generated content must be reviewed and verified by a human officer
• You are solely responsible for the accuracy of all reports submitted
• The AI is a tool to assist, not replace, human judgment

5.2 User Responsibility

You must:

• Review all AI-generated content before submission
• Verify the accuracy of all facts, dates, and information
• Make necessary corrections and edits
• Ensure reports meet your agency's standards
• Not rely solely on AI-generated content for critical decisions

6. Data Ownership and Rights

6.1 Your Data

You retain all rights to:

• Report content you create
• Information you input into the system
• Your agency's data

6.2 License to Badger AI

By using the service, you grant us a limited license to:

• Process your data to provide the service
• Store your data on our servers
• Use anonymized, aggregated data to improve our AI models (with your consent)

We do NOT: Sell your data, train AI models on your confidential reports without consent, or share your agency's information with third parties except as required by law.

7. Subscription and Payment

7.1 Subscription Tiers

Badger AI offers multiple subscription tiers:

• Free: Basic features with weekly usage limits (resets Mondays at 7:00 AM Eastern Time)
• Standard ($12/month): Enhanced features and higher limits
• Unlimited ($20/month): Unrestricted access to all features
• Agency Plans: Custom solutions for large agencies with specialized access controls

7.2 Payment Terms

• Subscription fees are billed in advance through Stripe
• Prices are subject to change with 30 days notice
• Refunds are provided in accordance with our refund policy
• You are responsible for all applicable taxes
• Weekly limits reset automatically every Monday at 7:00 AM ET

7.3 Cancellation

You may cancel your subscription at any time through the Stripe Customer Portal. Upon cancellation:

• You will retain access until the end of your billing period
• You will be automatically downgraded to the Free tier
• Your data will be retained according to our retention policy
• You may request data export before account closure

8. Referral Program

8.1 Program Terms

Badger AI offers a referral program where:

• Users can generate unique referral codes to share with others
• Referred users receive discounts on their first subscription payment
• Referrers receive free subscription time when referred users subscribe to paid plans
• Both referrer and referee must maintain active paid subscriptions for rewards to apply

8.2 Program Rules

You agree to:

• Not abuse the referral program through fake accounts or fraudulent signups
• Share referral codes only with genuine potential users
• Not spam or engage in unsolicited marketing with referral codes
• Comply with all applicable laws regarding referral marketing

8.3 Program Modifications

We reserve the right to:

• Modify or terminate the referral program at any time
• Adjust reward amounts or discount percentages
• Revoke rewards obtained through fraudulent means
• Suspend accounts that abuse the referral program

9. CJIS Compliance and Security

9.1 Current Status

Badger AI is designed with comprehensive CJIS security controls including:

• FIPS 140-2 compliant encryption (TLS 1.3)
• Multi-factor authentication
• 30-minute session timeouts
• Comprehensive audit logging with 3-year retention
• AWS Nitro System hardware-level security
• FIPS-compliant endpoints for all AWS services

9.2 Validation Process

Badger AI is currently undergoing formal CJIS validation. Upon completion of validation:

• We will notify all users of certification status
• We will maintain all required security and audit controls
• We will continue to implement updates as compliance requirements evolve

10. Confidentiality and Law Enforcement Data

We understand the sensitive nature of law enforcement data and commit to:

• Maintaining strict confidentiality of all reports and data
• Implementing appropriate security measures
• Restricting access to authorized personnel only
• Complying with all applicable law enforcement data regulations
• Maintaining separate access controls for individual users and agency administrators

11. Service Availability and Support

11.1 Uptime

We strive to maintain high availability but do not guarantee:

• Uninterrupted access to the service
• Error-free operation
• Immediate bug fixes or updates

11.2 Maintenance

We may perform scheduled or emergency maintenance that temporarily interrupts service. We will provide advance notice when possible.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Badger AI is provided "AS IS" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid for the service in the past 12 months
• We are not responsible for decisions made based on AI-generated content
• We do not guarantee the accuracy or reliability of AI outputs

13. Indemnification

You agree to indemnify and hold harmless Badger AI from claims arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of any laws or third-party rights
• Content you submit or create using the service
• Your agency's use of reports generated through the service

14. Intellectual Property

Badger AI and its technology, including but not limited to:

• Software code and architecture
• AI models and algorithms
• User interface designs
• Trademarks and branding

Are the intellectual property of Badger AI and protected by copyright and other laws.

15. Termination

15.1 By You

You may terminate your account at any time by contacting us or canceling through Stripe.

15.2 By Us

We may suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• Your account poses a security risk
• Payment is past due
• You abuse the referral program or subscription limits

15.3 Effect of Termination

Upon termination:

• Your access to the service will be revoked
• You may request a data export within 30 days
• We will retain data as required by law or for legitimate business purposes
• Outstanding subscription fees remain due

16. Changes to Terms

We may modify these Terms at any time. Changes will be effective:

• Upon posting to our website
• After email notification (for material changes)
• Upon your continued use of the service

If you do not agree to changes, you must stop using the service.

17. Governing Law and Disputes

These Terms are governed by the laws of the United States and the state where Badger AI is incorporated, without regard to conflict of law principles.

Any disputes shall be resolved through:

• Good faith negotiation first
• Binding arbitration if negotiation fails
• Courts of competent jurisdiction as a last resort

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Badger AI regarding use of the service.
